Xunta de Galicia has authorized the modification of an article of the decree of recasting in matters of travel agencies, tourist guides and active tourism with the aim of adapting it to the European framework. In particular, the amendment concerns Article 16 of Decree 42/2001 as regards the guarantees to be provided by tour operators for users. The guarantee resulting from this modification will thus provide further protection to the users.
The guarantee resulting from this amendment will thus provide greater protection to users against the bankruptcy or insolvency of package tour operators, who must provide this guarantee prior to the exercise of their activity and maintain it permanently. This guarantee will make it possible to meet the obligations arising from the provision of contracted services and to reimburse passengers for payments actually made insofar as they are not provided. The decree was submitted to the perceptive report of the Consello de Turismo as well as to the consultation of the most representative organizations of the sector, including the Galician Tourism Cluster, and the report of the Consello Galego de Consumidores e Usuarios. It shall enter into force on the day following its publication in the Official Journal.
